Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Voice Back LLC ("Company," "we," "us," or "our"), a limited liability company registered in Illinois, covering the Voice Back AAC app for voice banking and message banking, the website (voicebackapp.com), and any related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms; if you do not agree, do not use our Services.

Anyone at least 13 years old, including people living with ALS or MND who use Voice Back as a speech generating device, is eligible to use Voice Back. At registration, you must affirmatively confirm your age by checking a box stating "I confirm I am 13 years of age or older." By checking this box and creating an account, you represent that you meet this requirement. We reserve the right to terminate accounts where we have reason to believe this representation is false.

You agree to provide accurate information during registration, maintain the security of your account credentials, notify us immediately of any unauthorized access at support@voicebackapp.com, and accept responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts used fraudulently or in violation of these Terms.

4.1 Permitted Use

Voice Back grants you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial use in accordance with these Terms.

4.2 Prohibited Conduct

You agree not to:

• Use the Services to impersonate any person without their consent, including creating voice clones of others without their explicit permission
• Upload audio or video containing content you do not own or have rights to
• Use the Services to generate voice content for fraudulent, deceptive, or illegal purposes
• Attempt to reverse engineer, hack, or disrupt the Services
• Use the Services to harass, threaten, or harm others
• Violate any applicable local, state, national, or international law

By submitting audio or video recordings to Voice Back, you represent that you have the legal right to submit that content and grant us permission to process it for the purpose of generating a voice model. You retain ownership of your voice recordings. You are solely responsible for ensuring you have consent from any person whose voice you clone using our Services.

We reserve the right to remove any content that violates these Terms.

All content, features, and functionality of Voice Back — including but not limited to the app design, text, graphics, and code — are owned by Voice Back LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Certain features of Voice Back require a paid subscription. All payments are processed through Apple's App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Refunds are subject to the policies of Apple or Google. We reserve the right to change subscription pricing with advance notice.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY ILLINOIS LAW, VOICE BACK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Voice Back LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account and access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services immediately ceases. You may delete your account at any time by contacting support@voicebackapp.com.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising out of these Terms shall be resolved through binding arbitration in Illinois, except that either party may seek injunctive relief in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
